Undermentioned Business conditions (next written only as "BC") are valid for all contracts, deliveries and other services (next written only as "contract") offered by IMFsoft ltd. company (next written only as "provider"). These Business conditions came into operation since 1st January 2005.
For customers from Czech Republic and Slovakia are deliveries despatched by shipping service PPL. Payment is realized by cash on delivery in most cases. It is also possible to apply for issue of a payment bill. Deliveries are subsequently despatched after incoming of appropriate amount to our account.
For customers out of Czech Republic and Slovakia we despatch deliveries by DHL shipment service. Payment is possible to make by issued payment bill or on-line by payment portal PayPal.
Provider doesn´t request any minimal quantity. All prices include VAT (20%).
Products which we have in stock at the moment are given to dispatch (Czech post) during five working days. If we don´t have wanted product in stock we try to subserve deliveries in the shortest time we can. We reserve us the right to adequately lengthen the delivery date if we couldn´t fulfill a contract because of snags, delivery problems of our subcontractors or other similar reasons that we can´t influence. Customer has title to establish new adequate delivery date with a menace of contract avoidance if original contract won´t be fulfill because of different reasons than hereinbefore mentioned. Customer has title to total avoidance of contract if even new delivery date won´t be fulfilled by provider. Customer and provider have title to total avoidance of contract if reason for non-performance of a contract would be delivery problems of our subcontractors or if delivery date would lengthen more then six calendar weeks. Compensation for damages evoked by delivery date lengthening or non-performance of a contract are exempted.
Provider quarantees 14 days deadline for returning of unused product. Title to product returning is quaranteed if customer will return product in determined date (stamp of customer´s post) in original cover, unused and undamaged. Returned product shall be accepted by provider only if sending will be prepaid. Sendings with COD won´t be accepted.
Provider gets responsibility for products´ transportation to dispatch firm. This responsibility of provider ends with products handovering to dispatch (Czech post) and then comes to customer. To every order (except personal acceptance) is accounted postage and packaging.
Provider quarantees that sold products while handovering to dispatch are without material even manufacture defects and they have qualities said in contract. Customer have to check products´ quality immediately after delivery. If customer discover any defects or differentness in its quality or quantity written in delivery note or bill, he has to tell provider about this situation during one calendar week (by fax machine or e-mail). Duration of guarantee on our products is 24 months since sell-by date.
Guarantee doesn´t relate to these cases: - wear and tear of product – if product was changed, opened or repaired by customer (except provider permit) – product wasn´t used according to technical standards.
Provider has title to free repairing of product during guaranty time; partial component or whole product changeover is allowable. Customer has title to avoidance of contract or deduction from the price in case of defect won´t be take out by provider in adequate time.
Until complete payment products are in ownership of IMFsoft ltd. company.
Provided customer´s data needed for successful order fulfilment are processed and stored by electronic ways. IMFsoft ltd. company explicitly undertakes that these data shall be stored carefully not to be misused or provided to the third person.
